Pedestrian Accidents

A pedestrian accident occurs when someone who is walking is struck and injured by a motor vehicle. It is important to preserve your rights if you are involved in a pedestrian accident. Do not speak with any insurance company until you have had an opportunity to speak with an attorney. Many clients worry about how their medical bills will get paid if they are injured as a pedestrian. The Fraga Law Firm is ready to discuss your accident with you and explain how we can get you compensation for your damaged property, medical bills, loss of income, out of pocket expenses, future medical bills and pain and suffering.

The following are steps to take if you have been involved in an accident as a pedestrian:

  1. Call the Police to Create a Police Report: Call 911 and report that you have been involved in an accident as a pedestrian. Once a police officer arrives, make sure to explain to the officer how the accident happened. If you are aware of witnesses who saw the accident ask the police officer to speak with them. Make sure you obtain the Driver’s Exchange of Information or crash report number in order to obtain the police report once its ready. It is also important to obtain the other party’s insurance information at the scene to ensure a claim can be opened immediately.

  2. Seek Immediate Medical Attention: If you are experiencing any pain, including mild pain or discomfort, road rash or other injuries, seek immediate medical attention. If you feel pain at the scene of the accident ask for fire rescue to examine you. Do not worry about the medical bills if you do not have health insurance coverage or Personal Injury Protection (PIP), the at fault party is responsible for your medical bills.

  3. Preserve as Much Evidence as Possible: Take pictures of the vehicles involved, pictures of the scene of the accident, pictures of the intersection and skid marks and pictures of your injuries. Write down witness contact information, and any other information that you feel will be important in this matter.

  4. Call The Fraga Law Firm: Call us to discuss your rights before speaking to any insurance company. While you are focusing on healing we will handle all aspects of your claim including obtaining compensation for repair of your damaged property, medical bills, loss of income, out of pocket expenses, future medical bills and pain and suffering.
